Default E-brake is stuck down

My emergency brake has been stuck down ever since i bought my jetta what do you think the problem is. Could i yank or pry it up?

its probablyrusted "shut" thats what happeneded to mine. use wd40 and a second hand to get it to move again. Check the rear e-brake spring on the caliper. that helped me a lot
